This monitoring is in place to ensure compliance with our Terms of Service, detect any attempts to bypass the platform, and maintain a safe environment for all users. However, monitoring does not equal supervision. Collab. does not supervise, direct, or control the actual work being performed, nor does it review the quality or accuracy of any deliverables. The working relationship, project execution, and all professional responsibilities remain solely between the client and the freelancer.
Can I move a project off-platform before 36 months?
Yes, under specific conditions. Project-based off-platform work is permitted from 0–36 months if the client pays the applicable conversion fee to Collab. Permanent employment conversion is also allowed at any time, with the client paying the CTC-based fee to Collab.
What happens during the 36-month period without conversion?
- All contracts, milestones, and payments remain on Collab.
- Standard platform fees (10% each for client and freelancer) apply to all billings.

Can a client hire multiple freelancers from Collab. during the 36-month period?
Yes. The 36-month rule applies per client-freelancer relationship. You may engage new freelancers at any time—each relationship has its own 36-month clock starting from that specific contract's start date.
What happens if a client or freelancer bypasses Collab. during the 36-month period?
Bypassing Collab.—accepting side payments, moving project work off-platform, or attempting to hide the relationship, whether by formal contract or informal agreement—is a direct violation of our Terms of Service.
South African law protects Collab.'s right to enforce this agreement. The Consumer Protection Act 68 of 2008 recognises the validity of fair terms of service. The Contracts for the International Sale of Goods Act 4 of 1986 and common law principles of breach of contract provide legal recourse. Collab. will pursue:

You're free to work together outside Collab. on that specific converted project or employment relationship—use your own systems, your own payment methods, your own contracts. Collab. no longer facilitates payments or provides dispute resolution for that converted work.
Do I lose payment protection?
Yes. Once converted, Collab.'s payment protection and dispute resolution services no longer apply to that specific project or employment relationship. You manage all ongoing work terms and payments directly.
Can a converted freelancer still apply for jobs on Collab.?
Yes. Conversion applies only to that specific project or employment relationship. The freelancer:
- Retains their profile
- May continue using Collab. to find work with other clients
- May take on fixed-price, hourly, or retainer projects with other clients
- Is simply not eligible for new contract-to-hire opportunities while in full-time employment
What if our off-platform arrangement doesn't work out?
You may return to Collab. to find new talent. Your account remains active and in good standing, provided you followed proper conversion procedures.
Can we reverse a conversion and come back on-platform?
No. Once a contract is converted, it cannot be reactivated on Collab. You would need to post a new opportunity and engage through a new contract.
Are there refunds if the conversion doesn't work out?
No. Refunds are not provided after a conversion, regardless of whether the relationship ends by mutual agreement, termination, or any other circumstance. The Conversion Fee is final once paid and cannot be applied to future trials. Collab. is not responsible for conversion outcomes.
Collab. will not be held liable for anything that transpires after conversion, whether per project or permanent. This is precisely why Collab. gives you the option to trial first—so you can evaluate fit, expertise, and working style before committing to convert.
What is Collab.'s role in all of this?
Collab. is not a recruitment agency and does not act as an employer. We are not responsible for the services, conduct, or actions of freelancers under any circumstances.

Is Collab.'s 36-month rule enforceable under South African law?
Yes. Collab.'s Terms of Service are legally binding agreements governed by the laws of the Republic of South Africa. When you use Collab., you enter into a voluntary agreement to abide by these terms.
The following South African legislation and legal principles support and protect Collab.'s right to enforce its terms:
- Consumer Protection Act 68 of 2008– Recognises the validity of fair and reasonable terms of service agreed to by consumers and suppliers.
- Contracts for the International Sale of Goods Act 4 of 1986– Supports the enforcement of commercial agreements entered into freely by contracting parties.
- Common Law of Contract– South African common law recognises that parties who voluntarily enter into agreements are bound by their terms. Breach of contract entitles the aggrieved party to claim damages, specific performance, or cancellation.
- Electronic Communications and Transactions Act 25 of 2002– Provides for the legal recognition of electronic agreements, including terms accepted through online platforms.
- Copyright Act 98 of 1978– Protects Collab.'s proprietary platform, technology, and intellectual property from unauthorised use or reproduction.
What legal action can Collab. take if a client or freelancer bypasses the platform?
Collab. reserves the right to pursue all available legal remedies, including:
- Instituting legal proceedings in a South African court having jurisdiction.
- Claiming damages equal to the Conversion Fees that would have been payable.
- Claiming consequential damages arising from the breach.
- Seeking interdicts (injunctions) to prevent further breach.
- Recovering all legal costs on an attorney-and-client scale.
- Permanent account suspension and forfeiture of all platform privileges.
Bypassing Collab.—whether by accepting side payments, moving work off-platform, or attempting to hide the relationship—is a direct violation of our Terms of Service and will be pursued to the fullest extent of the law.
Which courts have jurisdiction?
The parties consent to the non-exclusive jurisdiction of the Magistrates' Court or, where its jurisdiction is limited, the High Court of South Africa situated in Gauteng.
What if a client or freelancer resides outside South Africa?
Collab. operates globally. Our Terms of Service stipulate that any dispute shall be governed by South African law and submitted to the jurisdiction of South African courts, regardless of the user's location.
Does Collab. comply with South African data protection law?
Yes. Collab. complies with the Protection of Personal Information Act 4 of 2013 (POPIA) . All personal information collected, processed, and stored is handled in accordance with POPIA's conditions for lawful processing. Your information is used only for verification, security, and platform operations, and is never shared without your consent.
Are Collab.'s terms available in other South African languages?
Currently, Collab.'s Terms of Service are provided in English. This ensures consistency and clarity in all legal and contractual matters.

Prohibited Conduct: Any payments made outside the platform that bypass Collab.'s fees, or any off-platform conversions conducted without Collab.'s authorization, are strictly prohibited and constitute a breach of our Terms of Service.
Enforcement: Collab. reserves the right to pursue all available legal remedies, including but not limited to:
- Recovering unpaid fees and damages through legal proceedings.
- Seeking interdicts (injunctions) to prevent further breach.
- Permanent account suspension and forfeiture of all platform privileges.
- Recovering all legal costs on an attorney-and-client scale.
Users who engage in unauthorized bypass or conversion do so entirely at their own risk and without recourse to Collab.
